Whats the difference between handing out the actual hacked rom versus an ips patch of your changes?

ROMs contain the original copyrighted material.

Distributing ROMs is discouraged since it raises awareness by companies such as Big N.

IPS patches are almost always smaller than the ROM they're patching.
